These Terms govern your use of Phishmake. Please read them carefully before creating an account or running a campaign. Effective date: 1 June 2026.
Acceptance of Terms
By accessing or using Phishmake, you agree to be bound by these Terms. If you do not agree with any part of them, you may not use the service. Continued access after updates means you accept the latest version.
Use of Service
Phishmake provides phishing simulation, employee management, and security awareness tools intended for organizations to train their own staff. You are responsible for ensuring your use complies with the laws and policies that apply to your team and region.
Account Registration
To use most features you will need an account. You agree to provide accurate information, keep your credentials confidential, and notify us promptly at support@phishmake.com if you suspect unauthorized access.
Subscription & Billing
Paid plans are billed in advance on a recurring basis. Fees are non-refundable except where required by law. You may cancel at any time; the cancellation takes effect at the end of the current billing period.
Acceptable Use
You may only run phishing simulations against employees or contractors whose organization has authorized testing. You agree not to use Phishmake to send unsolicited messages, deceive third parties outside your organization, harvest credentials for unauthorized purposes, or interfere with the service's normal operation.
Authorization for Simulations
You confirm that you have the legal authority to run phishing simulations against the recipients you upload to the platform. Phishmake is not responsible for use of the service outside this authorization.
Intellectual Property
The Phishmake platform, including its software, design, and templates, is owned by Phishmake and protected by intellectual property laws. You retain ownership of the content you upload; you grant Phishmake a limited license to host and process that content solely to provide the service.
Data & Privacy
How we handle personal data is described in our Privacy Policy. You are responsible for obtaining any consents required from your employees before uploading their information to Phishmake.
Service Availability
We work to keep Phishmake available and performant, but we do not guarantee uninterrupted access. Planned maintenance and unforeseen outages may occur. We are not liable for losses caused by temporary unavailability.
Limitation of Liability
To the maximum extent permitted by law, Phishmake is not liable for indirect, incidental, or consequential damages arising from your use of the service. Our total liability for any claim will not exceed the fees you paid in the twelve months preceding the claim.
Termination
You may close your account at any time. We may suspend or terminate access if you breach these Terms, if required by law, or if continued access poses a risk to the platform or other users. Provisions that by their nature should survive termination will do so.
Changes to These Terms
We may update these Terms from time to time. When we do, we will revise the effective date below and, for material changes, notify account owners by email or in-app. Continued use of Phishmake after the update means you accept the new Terms.
